Terms and Conditions (including Pre-enrolment Document)

When you enrol (register) with the London Centre for Advanced Training and Education (“LCATE”), you and we will accept the following terms and conditions.

Some of these terms and conditions are required by UK law.

TERMS AND CONDITIONS OF ENROLMENT (INCLUDING Pre-Enrolment Document, Limited Liability & Disclaimer)

 TERMS & CONDITIONS

 Please read these terms and conditions they apply to:

a) Online Course(s);

b) Online Diploma in Law Course; and

c) Site Course(s); respectively.

  • When you enrol (register) on a course delivered by the London Centre for Advanced Training & Education (LCATE), you and we accept the following terms and conditions. Some of the terms and conditions are required by UK law. Please read the terms and conditions applicable to you. This document is divided into two parts. The first part deals with Online Courses and the Online Diploma in Law Course. The second part details with Site Courses.

This documents also includes the ‘Pre-enrolment Document/Information’ which forms the final part of this document.

Please read the following information carefully.

  • DEFINITIONS

‘Course’ means the period of time You will participate in a single course which will comprise of one of the following: (a) an Online Course; or (b) an Online Diploma in Law Course; or (c) a Site Course as better defined in this definitions section below.

‘Deposit’  – means the deposit payable by You for enrolment on a Site Course.

‘Diploma in Law Certificate’ means the certificate You will receive on successful completion of the Online Diploma in Law Course.

Force Majeure’ unforeseeable circumstances that prevents You from fulfilling a contract.

‘Full Course Fee’– means the full fee that You have to pay to LCATE enrolling on (a) one of the Online Course(s); or (b) the Online Diploma in Law Course; or (c) one of the Site Course(s).

‘Listed University’ means an English university listed as one which recognizes the Online Diploma in Law Course.

‘Online Diploma in Law Course’ – means You, the student wishes to join one or all of the four units described in the online diploma course advertised on the website and which on successful completion of the course will allow You, the student to enrol or register at one of the Listed Universities which recognize the qualification as an access law course.

‘Online Course(s)’ means, You the student wishes to join a course of study solely delivered electronically via email.

Short Online Course(s)‘ means, You the student wishes to join a course which is takes less than 5 months to complete and costs less than £500.  This also applies, if you purchase the course from a third party platform such as ‘Reed’ and you have purchased it for a lower price than the original £500.

‘Personal Data’ means all data relating to You which includes your name, surname, email correspondence, including contents of correspondence or any other form of correspondence, including documents disclosing information pertaining to You, including information pertaining to your passport, other forms of Identification and records.

Pre-Enrolment Information document’ means the document disclosed in Appendix 1 of these Terms & Conditions.

Site Course(s)’ means, You the student, wishes to join one of the courses of study advertised by LCATE, at the venue where LCATE provides face-to-face tuition.

‘You’ means, You the student who wishes to join a course of study with LCATE as an enrolled student.

Your’ means anything relates to you or belongs to you.

‘We’ and ‘Us’ means LCATE.

 

DISCLAIMER WITH REGARDS TO ONLINE COURSES 

LCATE commits to keeping our products compatible with all modern web browsers including (but not limited to) Firefox, Safari, Chrome (all on PC & Mac) & Internet Explorer.

While LCATE makes its best effort to give a near-identical experience across each of these browsers, it is impossible to compensate for the lack of web standards support (relating to HTML & CSS) in some of these browsers. In the case of a browser not support certain web standards, LCATE will include a generic workaround for that browser, which will degrade a specific function / feature gradually and in a way that doesn’t affect You experience negatively.  LCATE is not liable or responsible if for some reason You do register and enrol on an Online Course and are unable to access the Course due to an incompatible browser. In some circumstances as stated above in ‘Limited Liability’ LCATE can exercise a discretion part of the Course Fees paid but not exceeding the amount stated under the ‘Limited Liability Clause’ above.

REGISTRATION: ONLINE COURSES & ONLINE DIPLOMA IN LAW COURSES

A) Enrolment (Registration) – Online Courses & Online Diploma in Law Course

 When You enrol on an Online Course or one or more units of the Online Diploma in Law Course, You must complete the enrolment form and pay the Full Course Fee(s) for the respective course.

In addition, You agree to pay any shortfall payment due to bank charges and currency exchange. We will provide proof of the shortfall to You from our bank if you request it.

We are not liable for refunds or any costs incurred by You due to frustration of contract caused by a Force Majeure event. We recommend that you take out personal insurance.

B) Information required by LCATE – Online Courses & Online Diploma in Law Course

When You enrol on one or more units of the Online Diploma in Law Course You must within 7 days of enrollment of the course provide to LCATE the following information (Information):

  1. A copy of Your passport or a copy of Your form of Identification; and
  2. A copy of any of Your English language certificate or a letter from a recognized college or university supporting Your competency in the English Language and Your ability to undertake Online Diploma in Law Course; and
  3. Evidence of your current residence in your home country; and (if applicable)
  4. Evidence of any criminal or civil convictions that would affect your entry to the UK to complete the Online Diploma in Law Course or secure entry at a Listed University. Failure to provide the above mentioned Information will mean that LCATE reserves the right to cancel Your enrolment on the Online Diploma in Law Course and reserves the right not to provide You with a refund of the Full Course Fees.

C) Specific terms – Applicable to the Online Diploma in Law Course 

  1. You agree that You are the person disclosed in Your form of identification;
  2. You agree to be the student who studies each unit of the Online Diploma in Law Course;
  3. You agree to be the only student who carries the relevant research pertaining to the submission of each assignment required as part of the Online Diploma in Law Course;
  4. You agree to submit each assignment in accordance with the requirements provided on the website;
  5. You undertake to do the assignments yourself;
  6. You agree not to carry out any activity which would constitute clear plagiarism.

If LCATE has reason to believe that the work was not carried out by yourself, but by some other person or it clearly constitutes plagiarism, LCATE will, without reason, immediately cancel Your enrolment on the course.

LCATE will not be provide You with a refund of any or part of Your Full Course Fees.

Please read the following information carefully.

 

3. RIGHT TO CANCELLATION & REFUNDS

You have the right to cancel your order up to 14 days after your order is made.

3.a – Refund – Short Online Courses
  1. If you have completed between 50% to 95% of the course you have no right to a refund
  2. If you have completed between 15% to 50% of the course you have the right to a 50% discount

3.b – Refund – Online Diploma in Law or any Modules relating to the Diploma in Law

You have 14 days from the day You pay for one of your Module(s) to have a full refund. After 14 days has expired you will have no right to a refund. This applies even if you have commenced the course or you have not.

  1. In the event you unable to access the Course online due to reason(s) unknown to You, LCATE make exercise a discretion to provide You with a full refund provided You provide LCATE with evidence; if no evidence is provided within 7 days, no refund will be provided.
  2. In the event you are unable to access the Course online due to the fault of LCATE You will be provided with a full refund

4. DISCLAIMER WITH REGARDS TO ONLINE DIPLOMA IN LAW 

LCATE does not accept responsibility for the following:

  • Your failure to complete each Module within the 5 month time period (includes the assignments and multiple choice tests);
  • Your failure to start the course within the 14 days required in order for you to ascertain whether You can do the Course or request a full refund;
  • Your failure to be connected to an appropriate server in order to complete each Module;
  • Your failure to provide the requisite Smart Charts to LCATE for each Lesson completed and also your failure to provide a Smart Chart with each of the respective assignments;
  • Your failure to take any IELTS exams or English qualification which is necessary for your enrolment at any university in England;
  • You agree that upon successful completion of the online Diploma in Law, that you will be responsible for applying to any university regarding your application for entrance to study a degree. LCATE is not responsible for any rejection by any university of your admission.
  • You agree that each university will have their own selection process.
  • We also disclaim any liability if you do not complete any online course within the prescribed time limit.

5. YOUR PERFORMANCE & PROHIBITIONS

  1. Your performance will be monitored by LCATE for legitimate purposes of being sure that you have fulfilled your contract.
  2. As part of your Course you will be expected to purchase reading material which has been recommenced by LCATE.
  3. You agree that LCATE’s material is just a guideline.
  4. You agree not to copy or carry out any type of plagiarism.
  5. You agree to listen to all the lesson(s) and review(s) in each Module.
  6. You agree to do the Multiple Choice Test(s) allocated to each Module.
  7. You agree, if applicable to do presentation(s).
  8. You agree, if applicable to do Your final research project.
  9. You agree to complete and submit the Smart Chart for each of the lesson(s) and also a Smart Chart with Your assignment. Example: Smart Charts for each lesson from ‘Offer to end of Consideration’ including the Smart Chart for the assignment 1.
  10. You understand that failing to submit and assignment and the respective Smart Charts will constitute a fail and your assignment will not be marked.
  11. You agree to do all the multiple choice tests.
  12. You agree that in order for you to successfully complete the Diploma in Law you will need to successfully complete all the Module(s) which are defined above within a period not exceeding 20 months.
  13. You agree that all material regarding the online Diploma in Law is the intellectual property of LCATE and you will not copy in whole or any part of the material of LCATE.

9. You also agree that you will not provide derogatory comments regarding the Course to any individual and or publish the same any statement which can bring LCATE’s organisation into disrepute.

You agree to provide LCATE with permission to use your email:

  1. to correspond with you in order that you fully complete the respective Module(s);
  2. to disclose your full name, copies of your passport(s) and correspondence details to Athe or any other regulatory organisation which has the sole aim of ensuring that LCATE is in compliance with their regulations when providing the Diploma in Law.

LCATE agrees to destroy this information within 4 years after the date of completion by you of the Diploma in Law or earlier if you decide to terminate the Course earlier or complete one or two Modules only.

You have read the terms of this agreement and you agree to all terms.

Final Exam – Applicable to the Online Diploma in Law Course

Upon completion of the four required units required by You under the Online Diploma in Law Course, You may be required to enter the UK in order to take the final Diploma in law exam.

Conditions for Entry including further fees payable – Online Diploma in Law Course

The following further terms and conditions apply: 

  1. You agree to paying LCATE extra fees for any future revision course(s) that you may require pertaining to any courses held by LCATE (online or site); and
  2. You agree that you have read the Pre-Enrolment Information document (Appendix 1, enclosed) and comply with any terms and conditions that affect You, in particular if You are arriving into the UK from outside the European Union, You have the requisite visa to enter the UK to undertake the Final Exam; and
  3. If You are a student entering from a non-European Union country, you will be required to enter the UK with the correct student visa;
  4. You agree that LCATE does not take any responsibility for Your failure or any delay in You being granted a visa which affects your ability to commence the Site Course including events of frustration or Force Majeure;
  5. You agree that under the circumstances, it would be advisable you take out insurance to cover any loss of costs.

Unable to have access or have problems having access to the ‘Online Diploma in Law Course’

  1. LCATE will not be responsible nor liable in the event that you are unable to have access the Online Diploma in Law as a result of an issue with Your computer or Your server.
  2. In the event there is an issue LCATE will do its utmost to resolve the issue and will require Your collaboration.
  3. Any delay in ensuring that You have access to the Online Diploma in Law Course will not affect Your marks.
  4. LCATE will provide you with an alternative method of ensuring that You complete the course.  This could comprise of You having access to hard-copies of the lecture notes that relate to the Online Diploma in Law Course and possibly comprise of you having tuition via Skype at least twice a month to ensure that You fully understand the contents of the Diploma in Law and are able to complete the Diploma in Law Course.

Listed University – Online Diploma in Law Course – After successful completion of Final Exam

  1. You agree that You will be responsible for ensuring that You have the relevant additional English language certificates necessary for You to secure a place at a Listed University; and
  2. You agree that even if you do undertake the Online Diploma in Law Course and successfully complete the Final Exam, the Listed University may not offer You a place at their university to commence a law degree, due to full admission, or reasons the Listed University, may not disclose; and
  3. You agree that LCATE will not be responsible or liable in any way whatsoever if a Listed University does not provide You with a place to start a degree course at their university; and
  4. As the Online Diploma in Law Course is delivered online, You agree that the Listed University may also require you to take a further exam to ensure that no plagiarism or fraud took place by You or overseas when you commenced the Online Diploma in Law Course.

DATA PROTECTION – Online Courses & Online Diploma in Law Course:

 You agree that LCATE is allowed to use your Personal Data for the following reasons:

  1. To use Your Personal Data when corresponding with You for the purposes assisting you on Your Online Diploma in Law Course;
  2. To store Your Personal Data for regulation purposes for a period not exceeding 4 years;
  3. To transfer Your data, if required by You, in order to secure a place at a college or university;
  4. To transfer Your Personal Data if required by the laws of England & Wales. Any other use of Your Personal Data by LCATE will require written consent by You.
  5. Please also refer to our Privacy policy which explains this in detail.

Certificates

1. You are aware that You may be charged an extra fee for any qualifications that you take at LCATE.

2 You will be required to attend a final exam in order to attain the final Diploma in Law Certificate.

6. REGISTRATION – SITE COURSE(S)

Enrolment (Registration) – Site Course(s)

When You enrol on a Site Course, You must complete the enrolment form required and pay the Deposit for the course as disclosed on the website.

Providing information to LCATE – Site Course(s):

 When You enrol on Site Course, You must, within 7 days of enrollment of the course provide to LCATE the following information (Information):

  1. A copy of Your passport or a copy of a form of Identification; and
  2. Details of your accommodation arrangements in the UK;
  3. A copy of any of Your English language certificate or a letter from a recognized college or university supporting Your competency in the English Language and Your ability to undertake the Site Course;
  4. Evidence of any criminal or civil convictions that would affect your entry to the UK to undertake the Site Course.

6.a – Offer Letter – Site Course(s) Once You have paid the Non-Refundable Deposit and provided the Information listed above, LCATE will provide You with an Offer Letter.

6.b – Students – Entering the UK from outside the European Union

If You are a student entering from a non-European Union country, you agree that you have read the Pre-Enrolment Information document (Appendix 1 enclosed).LCATE does not take any responsibility for Your failure or any delay in You being granted a visa which affects your ability to commence the Site Course or a Force Majeure event. Under the circumstances We advise you take out insurance to cover any loss of costs.   

6.c – Data Protection – Site Course:

You agree that LCATE is allowed to use your Personal Data for the following reasons:

  • To use Your Personal Data when corresponding with You for the purposes assisting you with Your Site Course;
  • To store Your Personal Data for regulation purposes for a period not exceeding 4 years;
  • To transfer Your data, if required by You, in order to secure a place at a university or college;
  • Provide LCATE of details of your accommodation in the UK;
  • To transfer Your Personal Data if required by the laws of England & Wales. Any other use of Your Personal Data by LCATE will require written consent by You.

6.c – Pre-enrolment Information document – Site Course

You agree that you have read the Pre- Enrolment Information document and comply with any terms and conditions that affect You, in particular if You are arriving from outside the European Union, You have the requisite visa to enter the UK to undertake the Course.

6.d – Final Payment of Site Course Fees

You agree to pay the Your final balance of the fees within 7 days from the commencement date of the Site Course. In addition You agree to pay any shortfall payment due to bank charges and currency exchange. We will provide proof of the shortfall to You from our bank if you request it. Failure to pay within the prescribed time-limit will mean that You will not be allowed to commence the Site Course.

6.e – Cancellation and refund of Site Course fees 

    1. If You arrive late or are absent from the Site Course for any reason at all, We will not refund any part of Your Full Course Fees that you have paid;
    2. If You cancel Your enrolment 30 days or more before the start of the Site Course, We will not refund You Your Deposit.   If you have paid the Full Course Fees, then we will refund you course fees minus the Deposit.
    3. If you cancel between 89 and 60 days before the start of the Site Course we will refund you 50% of your total Full Course Fees. We will not refund Your Deposit.
  • If You cancel 59 days or less before the commencement date of Your Site Course We will not refund you any of your Full Course Fees. We will not refund the Deposit. We strongly recommend that You purchase insurance against cancellation.
  • We are not liable for refunds or any costs incurred by You due to frustration of contract caused by a force majeure event.

6.f – Possible postponement of Site Course(s)We recommend that You purchase insurance against any cancellation regarding Your Site Course(s).

  1. There is no automatic right to postpone Your commencement on a Site Course by LCATE.
  2. You may find a place on a Site Course at a later date at the discretion of LCATE.
  3. There is no automatic right to place You on another Site Course.
  4. If a place does become available on another Site Course, LCATE reserves the right to charge 50 % of the course fees for transferring You on the Site Course.
  5. You can take the Site Course within 6 months of the original date of the commencement of your previous enrolment course date.
  6. A second postponement may be treated as a cancellation and terms and conditions of cancellation will apply at LCATE’s discretion.     
  7. You are aware that You may be charged an extra fee for any qualifications that you take at LCATE. You have a discretion not to take the qualification after completion of the Site Course.
  8. We will run courses at Wembley, but reserve the right to relocate the venue for the course to another venue in London at reasonable notice to You in circumstances beyond our control.

6.g – Course Dates – Venue – Site Courses

The on-site courses will be delivered in Wembley, 10 minutes tube ride from Baker street tube station. LCATE reserves the right to change the venue.  Students will be provided reasonable notice of any such changes.

6.h – Tests & Certificates – Site Course(s)

In the event at student undertakes any tests including the Diploma in Law and the TOLES at LCATE they may have to pay additional costs for taking the test and their certificates.

6.i – DATA PROTECTION – Online Courses & Online Diploma in Law Course:

 You agree that LCATE is allowed to use your Personal Data for the following reasons:

  1. To use Your Personal Data when corresponding with You for the purposes assisting you on Your Online Diploma in Law Course;
  2. To store Your Personal Data for regulation purposes for a period not exceeding 4 years;
  3. To transfer Your data, if required by You, in order to secure a place at a college or university;
  4. To transfer Your Personal Data if required by the laws of England & Wales. Any other use of Your Personal Data by LCATE will require written consent by You.

Pre Enrolment Information for Students enrolling on courses at LCATE

INFORMATION PRIOR TO YOU LEAVING YOUR HOME 

IMMIGRATION ADVICE:

Most students, except those students coming from the European Union need a visa before they can come and study in UK.

If you are an international student you should check if you require a visa to study in UK.

You can get more information on www.ukba.homeoffice.gov.uk. If you require a visa you can contact LCATE using [email protected]

LCATE will be able to provide you with the necessary information in order for you to make the correct application when you are in your home country.

STUDENTS TRAVELLING WITH FAMILIES/DEPENDENTS:

All international students, who wish to bring their family members or dependents with them, should seek advice from LCATE and detailed information is available at www.gov.uk/government/organisations/homeoffice (this website is subject to change – the student should check this for any updates)

There are restrictions. You will not be allowed to bring family or dependents on your student visitor’s visa.

MONEY MATTERS:

BRINGING MONEY TO UK AND OPENING A BANK ACCOUNT IN UK: 

You should make necessary financial arrangements.

This means that you will need to have sufficient funds to cover your tuition fee, maintenance and living expenses for the duration for your studies.

You will get information about the total course fee, initial fee deposit and estimated living expense information from LCATE when LCATE provides you with your offer letter.

The course fees for each respective course is available on LCATE’s website.

If you are international student you will not have the right to work in the UK while studying your course at LCATE. Therefore, it is essential that you have finances in advance to support yourself.

Any staff of LCATE will be available to help you with the information required to open a bank account in UK.

TRAVELLING WITH THE CORRECT DOCUMENTATION:

Just before you travel and you are arranging your luggage, it is important to keep in mind what items you will need, such as documentation, when you arrive. Please ensure that during your travel to the UK your original passport and all your documents that you require for registration at LCATE on the first day including visa card, traveller’s cheques and credit cards are placed in your hand luggage and you have this on you at all times.

Please label your luggage clearly. You are strongly advised to put your information (Your Name, the Centre’s name and Address) inside your luggage as well, in case the outer labels become torn and your luggage is mislaid.

CLOTHING AND CLIMATE:

Please check the weather forecast prior to your departure and ensure that you have the correct clothing for the season.   If you prefer to purchase clothing in the UK, please ensure you budget for this expense.

ELECTRICAL EQUIPMENT: 

The British electrical supply is rated at 240 volts/50 cycles. It is important to review manufacturer’s instructions to ensure that any electrical equipment you wish to bring to the UK is compatible. Conversion plugs are widely available from electrical shops including the airports. You should also be aware of customs and import duties on items.

HEALTHCARE IN THE UK:

Preparations prior to your travel to the UK: 

Students from some countries are required to obtain a health certificate before they can be granted a visa or admitted to the United Kingdom. As this may take time, it is important for you to find out if you will have to meet this requirement when you enquire about obtaining a visa.   If your visa requires you to take a tuberculosis test or any other test then please prepare for this and give yourself ample time to undertake the test prior to your departure. LCATE does not take any responsibility and or liability for your failure to take the test at the respective time leading to the refusal of your visa.

If you already have a medical condition that requires attention also in the UK:

If you have a pre-existing medical or mental condition you may be particularly vulnerable to problems, we strongly suggest that you ask for advice from your doctor in your home country about whether studying abroad is advisable in your circumstances, and if so, what steps you should take to ensure your continued good health while in this country. You must therefore plan ahead to ensure that you can receive appropriate medical or psychological support when you arrive in the UK.

If you have a long term medical or mental condition it is a good idea to bring with you to LCATE a brief letter, in English, from your doctor outlining your medical history with a full list of the medication that you are taking. You should also plan to bring with you a 4-week supply of your medication.

The National Health Service Regulation (HC83/10) states that an international student enrolled on a course of study of 6 months or longer is eligible to use the National Health Service (NHS). The spouse and dependants under 16 (or under 19 if studying in school or further education) of such students are also eligible. If you will be studying in the UK for less than 6 months you will not be eligible for treatment under the NHS, and will be expected to pay for all health care.

If you are an International student, you may not be allowed to seek medical help from a doctor or hospital unless you pay for this expense. This also includes medication. You will have to pay for your medication if you purchase such medication in the UK. Please make sure you budget for this expense.

If you are an EU student, you may still need to obtain the correct medical cover from you home country if you require medical attention in the UK. However, as above you will be responsible for paying your own medication if you purchase your medication in the UK. Therefore, if you have an on-going illness then please factor into account this expense.

ARRIVAL IN THE UK:

At an extra fee LCATE offers an airport pick-up service.

When you arrive at the Airport, you will have to go through both Passport

You may also contact International Office, for any specific information. All passengers arriving at a UK port of entry are checked through immigration control. You will need to fill out a landing card on your flight and hand this to the immigration officer.
REFUSAL OF YOUR ENTRY IN THE UK

ACCOMMODATION:

LCATE is not responsible for providing you with accommodation. However, if you have difficulties regarding finding suitable accommodation, please contact LCATE for free and friendly advice and information to help you find the right place to live during your studies.

GETTING TO LCATE:

REGISTRATION OF COURSE:

On the day of your enrolment, you will be expected to attend LCATE an hour and 30 minutes before the commencement of the course. This is called the Pre-session work shop.

You will receive a warm welcome when you arrive at LCATE.

During the Pre-session work-shop a member of staff of LCATE will cover the following topics:

  • Welcome you to LCATE
  • Enroll you on your course
  • Pay your fees
  • Give an overview on how to open a UK bank account if necessary Some international students need to register with local police within seven days for their arrival. Please check your visa status and ensure that you take steps to do this.USEFUL WEB LINKS:

LIMITED LIABILITY

LCATE will not be responsible for You being unable to view the Online-Courses and complete the course due to your web-server being incompatible with LCATE’s website.

LCATE may exercise its discretion and provide You with some refund which will not exceed 30 per cent of any course fees.

LCATE will not provide You with a refund if You have attempted and not past the multiple choice tests or where it is clear that you have taken some tests and have attained a marked certificate of completion from LCATE.
